At Pura Vida Pets we work with complete clarity, care and safety. These are the rules and commitments behind your pet’s wellbeing and your peace of mind.

This English version is provided for convenience. The service is governed by the laws of the Republic of Costa Rica and the binding text is the Spanish one; in the event of any discrepancy, the Spanish version prevails. Clause numbering is identical in both languages.

Terms and Conditions for Dog Walking, In-Home Pet Sitting and Boarding

1. Pet Information Form and Health Requirements

1.1 It is mandatory to complete the Pet Information Form before starting or continuing any service that requires such information. This form allows us to understand the health, habits, behavior, needs, and specific care of each pet.

1.2 The client undertakes to provide complete, accurate, and up-to-date information, and to promptly report any relevant changes.

1.3 Pura Vida Pets will not be held liable for incidents or consequences caused directly by incomplete, incorrect, outdated, or omitted information provided by the client, without prejudice to liabilities legally corresponding to Pura Vida Pets.

1.4 Health and Vaccination Requirements: To safeguard the health of all pets and our staff, the client warrants that the pet has an up-to-date vaccination record (Rabies, DHPP/distemper-parvovirus, Kennel Cough / Bordetella where applicable), internal deworming, and current flea/tick prevention treatment. Pura Vida Pets may request the vaccination record at any time.

2. Acceptance and Limitation of Liability

2.1 These Terms and Conditions form part of the agreement for services and products offered by Pura Vida Pets.

2.2 Acceptance of these Terms and Conditions is a prerequisite to purchasing, booking, contracting, or renewing any service or product from Pura Vida Pets.

2.3 When booking is managed via the website, the client must expressly manifest acceptance using the enabled checkboxes or mechanisms before proceeding.

2.4 If the client chooses not to accept these Terms and Conditions, they may refrain from contracting. In such case, Pura Vida Pets is under no obligation to process the booking, acquisition, or service provision.

2.5 When contracting takes place through another channel, Pura Vida Pets may request equivalent confirmation of acceptance prior to formalizing the service.

2.6 No provision in these Terms and Conditions is intended to limit or exclude consumer rights or liabilities that are non-waivable under applicable Costa Rican law (Law No. 7472).

3. Tools and Accessories for Pet(s)

3.1 The client must provide suitable, safe, and functional equipment dedicated exclusively to their pet(s), such as collar, leash, harness, muzzle, or other required gear.

3.2 Pura Vida Pets is not responsible for accidents or consequences directly caused by client-supplied equipment that is defective, deteriorated, unsuitable, or in conditions that could not reasonably have been identified before the service.

3.3 Mandatory Muzzle Where Applicable: The client is responsible for providing and ensuring the use of a muzzle when required by current regulations, pet temperament/characteristics, or service safety conditions. The client must notify Pura Vida Pets in advance of any history of aggression, bite attempts, or reactive behavior toward persons or animals.

3.4 Females in Heat (Estrus) and Unneutered Pets: The client must immediately notify us if their pet is in heat. Pura Vida Pets reserves the right to adapt routes, reschedule group walks, or enforce special safety protocols to prevent altercations or unwanted breeding.

4. Waiting Time and Late Penalties

4.1 Our walkers arrive punctually at the indicated address and will wait up to 10 minutes to receive the pet(s).

4.2 If the pet(s) has not been handed over after this time, the walker may leave and the walk may be counted as completed, so as not to disrupt subsequently scheduled appointments for other clients.

4.3 If at the conclusion of the walk the walker must wait more than 5 additional minutes to return the pet(s), a waiting fee of ₡1,000 CRC per pet may apply.

4.4 Any pending fees must be settled prior to continuing further services or purchasing a new one.

4.5 If the client anticipates a delay for handover or collection of the pet(s), they must inform us at least one hour in advance where possible, to minimize scheduling disruptions.

4.6 Lightning and Severe Weather Protocol: In case of severe electrical storms (rayería) or meteorological alerts in Costa Rica endangering pet or walker safety, walks may be temporarily suspended, rescheduled, or replaced with a short indoor/sheltered comfort break, with time credited accordingly.

5. Photographs, Videos, and Promotional Content

5.1 During services, Pura Vida Pets may take photographs or videos of the pet(s) when necessary to compile reports, track service quality, maintain client communication, or document service performance.

5.2 The use of pet photos or videos for promotional, advertising, social media, ads, or website purposes is optional and subject to express authorization from the client.

5.3 Authorizing promotional content is never a requirement to purchase, book, or use ordinary services from Pura Vida Pets.

5.4 When promotional consent is granted, Pura Vida Pets will avoid disclosing personal data, specific locations, or private details that unnecessarily identify the client or their home.

5.5 The client may at any time request to stop future promotional use of photos or videos of their pet(s), without affecting their active services.

6. Monthly Packages

6.1 - 6.2 Options and Frequencies: Pura Vida Pets offers three main monthly package options: Basic (8 hours, 2 walks/wk), Pura Vida (12 hours, 3 walks/wk), and Premium (16 hours, 4 walks/wk). Frequency will be maintained according to the agreed schedule, provided client availability, walker logistics, and weather allow safe execution. Requests to increase frequency are assessed according to availability without automatic guarantee.

6.3 Unused Hours Policy: Walking hours left unused, scheduled, or rescheduled within the monthly package validity period must be consumed within the active package term.

6.4 Once the period concludes, unused hours due to client-attributable reasons cannot be rolled over to subsequent periods.

6.5 When a walk must be rescheduled due to circumstances attributable to Pura Vida Pets, a reasonable replacement option will be provided.

6.6 If Pura Vida Pets offers reasonable replacement alternatives and the client does not follow up or permit rescheduling within a reasonable timeframe, the Unused Hours Policy will apply.

6.7 Monthly Period: As a general rule, the monthly cycle begins from the package activation date through the corresponding date of the following month (subject to financing terms in clause 13.3).

When Pura Vida Pets cannot temporarily provide service due to reasons attributable to the company (such as walker absence without immediate replacement), the monthly package is automatically frozen at no cost to the client. The term pauses, unused walks do not expire, zero freeze fees apply, and the expiration date is extended by the exact number of suspended days. The freeze ends upon service resumption or upon client request for refund under clause 12.10.

7. Respect and Courtesy Towards Walkers

7.1 At Pura Vida Pets we believe in respect and kind treatment as the cornerstone of positive relationships between clients, walkers, and staff.

7.2 Walkers must be treated with cordiality and dignity at all times.

7.3 Verbal abuse, threats, harassment, assaults, or disrespectful conduct towards any team member will not be tolerated.

7.4 In serious or repeated instances, Pura Vida Pets may suspend service temporarily or permanently to protect its workforce.

7.5 If an active paid package is terminated early for this reason, Pura Vida Pets will calculate services rendered and determine the proportional refund due where appropriate.

8. Cancellation and Refund Policy

8.1 - 8.2 Prior Notice Windows: To cancel a scheduled in-home pet sitting or boarding service, at least 24 hours prior notice is required. For dog walks, cancellation must be communicated at least 1 hour prior to the upcoming walk.

8.3 When cancellation occurs within the established window, rescheduling or refund evaluation will be coordinated based on availability and contracted service.

8.4 Cancellations made with less than 24 hours notice for sitting/boarding, or less than 1 hour notice for walks, are non-refundable and the service may be deemed completed.

8.5 In case of cancellation of an incompletely consumed monthly package, Pura Vida Pets will calculate services performed and determine the proportional refund due.

This policy applies without prejudice to mandatory consumer rights under Costa Rican law. When an e-commerce or remote contract is legally subject to the right of withdrawal (retracto), the consumer may exercise it within 8 business days following completion of purchase. For successive services, withdrawal applies exclusively to the unperformed portion, with refund issued via the same electronic payment method within a maximum of 8 calendar days.

8.7 Duplicate, Excess, or Mistaken Payments: If an accidental double charge or excess payment occurs, the client has the right to prompt transaction review. Upon verification, Pura Vida Pets will refund the overpayment without penalty via the original payment method or mutually agreed mechanism.

9. In-Home Pet Sitting

9.1 Pura Vida Pets undertakes to deliver in-home pet sitting ensuring safe and proper conditions for the pet(s).

9.2 The client is responsible for maintaining the home environment in reasonably safe conditions for service execution.

9.3 The client must ensure pet areas are free of foreseeable hazards, toxic chemicals, dangerous objects, or unsafe zones that could compromise pet or staff wellbeing.

9.4 The client must communicate any behavioral quirks, medical conditions, or special requirements affecting service delivery.

9.5 The client must supply adequate food, medications, accessories, and supplies necessary for service performance.

9.6 Key Custody and Access Security: Where keys, access cards, or gate fobs are entrusted, Pura Vida Pets commits to strict custody and exclusive use for service duties. The client must lock or restrict access to private rooms not involved in pet care.

10. Pet Boarding

10.1 Pura Vida Pets ensures the host home is properly prepared, clean, safe, and suitable to welcome pet guests.

10.2 Prior to boarding, the client must supply thorough details regarding feeding, medications, routines, temperament, and special needs.

10.3 The client must supply pet essentials including food, medications, bedding, toys, dishes, and necessary accessories.

10.4 Supplied items must be in good condition; Pura Vida Pets is not liable for prior deterioration or normal wear and tear.

10.5 In case of medical emergency, Pura Vida Pets will attempt immediate contact with the client.

10.6 The client must collect the pet on the scheduled date and time. Any delays must be notified with maximum possible anticipation.

10.7 Schedule Extensions and Food Restocking: Unannounced collection delays exceeding one hour may incur surcharge fees subject to host availability. If supplied food runs out due to client delay, Pura Vida Pets will purchase suitable food, charging the direct cost to the client.

11. Emergency Protocols

11.1 In the event of a veterinary medical emergency during walking, sitting, or boarding, Pura Vida Pets will attempt immediate contact with the owner or designated emergency contact.

11.2 If communication is unreachable and the condition requires urgent intervention, Pura Vida Pets is authorized to transport the pet to a nearby veterinary clinic and make reasonable decisions to safeguard the animal’s life and wellbeing.

11.3 Veterinary fees arising from natural health conditions, accidents, or emergencies not attributable to Pura Vida Pets are the responsibility of the client.

11.4 This does not limit liabilities legally applicable to Pura Vida Pets when an event is directly attributable to wrongful acts or omissions under its responsibility.

12. Schedule Booking and Payment Methods

12.1 Individual Walks: Booking individual walk hours requires an upfront deposit of 50% of the total amount requested.

12.2 Schedule Confirmation: Time slots are not definitively confirmed until Pura Vida Pets verifies receipt of the corresponding payment and confirms service availability.

12.3 Monthly Packages: Monthly packages similarly require initial payment confirmation depending on the chosen purchasing modality.

12.4 Schedule Continuity: To maintain a recurring schedule, the client must renew within the renewal window to preserve their established slot.

12.5 Slot Release: If payment is not completed within the renewal period, reserved slots may be released and are no longer guaranteed, unless a valid freeze is in effect.

12.6 In-Home Sitting and Boarding: Payment must be completed at least 24 hours before service commencement. A 50% deposit scheme is available for multi-day services (single-day bookings require 100% upfront). If halfway through the booking the remaining 50% has not been settled, Pura Vida Pets may suspend remaining sessions until payment is cleared.

12.7 Official Payment Methods: Until direct gateway checkout is enabled, the only accepted payment method is SINPE Móvil (+506 8691-3459) in the name of Pura Vida Pets. Cash payments are not accepted, and payment is never handed to a walker: it is always made to the company. Submitting a receipt screenshot does not constitute definitive confirmation until funds are verified.

12.8 Booking Confirmation: A booking is deemed confirmed only when: 1. Pura Vida Pets verifies that payment was effectively received; and 2. Pura Vida Pets confirms availability and fulfillment via WhatsApp, website, or email. Digital acceptance does not replace this confirmation.

12.9 Unavailability or Service Interruption: If an assigned walker becomes unavailable after booking confirmation due to operational causes attributable to Pura Vida Pets, the package is automatically frozen at no cost (clause 6.8). Pura Vida Pets has an initial period of up to 7 calendar days to assign a replacement walker. Days paused extend package validity.

12.10 Refund for Replacement Impossibility: If 7 calendar days elapse without an acceptable replacement, the client may request a full refund of unused services (or choose to continue waiting with frozen validity).

12.11 Standard Walking Hours: Standard walk scheduling operates between 7:00 a.m. and 7:00 p.m., subject to availability. Walks outside standard hours are exceptional, requiring advance coordination, walker availability, and Pura Vida Pets approval, without creating permanent entitlement to said slot.

Administrative and customer support operates: Monday to Friday: 7:00 a.m. – 12:00 p.m. and 1:00 p.m. – 7:00 p.m. (administrative lunch break 12:00 p.m. – 1:00 p.m.); Saturdays: 8:00 a.m. – 1:00 p.m.; Sundays: closed for ordinary administration. Inquiries outside these hours are handled during the next business window. Out-of-hours assistance is discretionary and does not create an enforceable right to immediate response.

13. Benefits, Discounts, Loyalty Card, and Premium Card

13.1 Trial Walks: Pura Vida Pets may offer selected clients a trial of up to 3 walk hours over one week. For new clients, Pura Vida Pets may offer 1 free walk hour over a week (counted from first hour used; one-time benefit per client).

13.2 First-Purchase Discount: New clients may receive a 15% discount on their first monthly package purchase when this promotion is active. One-time use and non-combinable with other promotions.

13.3 Split Payment / Package Financing Scheme: Pura Vida Pets offers monthly packages split into two payments. 13.3.1 First payment: 50% of package price. 13.3.2 First 3 walks: client receives 3 initial walks to be used within 7 calendar days (treated as potential gifts, formalized only upon timely second payment).

13.3.3 - 13.3.4 Second Payment Window and Walk Pacing: Upon completion of the 3rd walk or expiration of the 7 days, an 8-calendar-day window opens for the second payment. During these 8 days, walks may continue at package frequency, capped at 25% of monthly hours per week and never exceeding 50% of total package hours before second payment.

13.3.5 Second Payment Within 8 Days: If paid within 8 days: 25% discount is applied exclusively to the remaining second half; the initial 3 walks become completely free gifts (not deducted from package); additional walks between walk 3 and payment are deducted; and monthly package term begins upon confirmation of second payment. Example: On a 12-walk package, using 3 initial walks + 2 additional walks within 8 days results in 3 free walks, 2 deducted walks, and 10 full package walks remaining.

13.3.6 - 13.3.8 Financing Exceptions and Opt-Out: The 25% discount does not stack with first-purchase or Loyalty Card discounts. If 8 days pass without payment (13.3.7), the 25% discount is voided, initial 3 walks are deducted from package hours, and service pauses at the 50% limit. If client opts out of completing financing (13.3.8), delivered walks are billed at standard single-walk rates (not discounted package rates), refunding any remaining balance.

13.4 Free Promotional Walks: Promotional or reward walks carry a maximum validity of 1 month from assignment unless stated otherwise. Expired walks cannot be exchanged for cash or transferred.

14. Multi-Pet Walking Policy

14.1 When a walk is contracted for two or more pets and one cannot attend due to client circumstances, the walk proceeds with the attending pet(s).

14.2 For monthly multi-pet packages, scheduled walks are counted as reserved, with no automatic right to refund or replacement session for the absent pet.

14.3 For sitting, boarding, or individual walks involving multiple pets, advance notice allows evaluation of proportional adjustments according to actual operational costs.

15. Service Exclusivity and Non-Solicitation

15.1 The client agrees not to enter into private agreements or direct hiring with walkers, sitters, or staff introduced by Pura Vida Pets outside company channels, without prior written consent.

15.2 Direct solicitation or private hiring with team members constitutes a contractual breach of these Terms and Conditions.

15.3 Upon verified breach, Pura Vida Pets may immediately suspend or terminate the commercial relationship with the client.

16. Confidentiality and Data Protection

16.1 Client Information: Pura Vida Pets maintains strict confidentiality over personal data provided by clients and pets, utilizing it solely to administer services, plan routes, respond to emergencies, and fulfill legal obligations.

16.2 Essential Service Data: Encompasses contact details, service address/location, pet health profile, schedule preferences, emergency contacts, medical directives, and payment confirmations.

16.3 Privacy Policy and Mandatory Consent: Clients must access the Privacy Policy and grant consent for essential data processing prior to booking. Refusal prevents contract completion.

16.4 Optional Consents: Commercial promotions and promotional use of pet photos/videos in marketing are entirely voluntary. Refusal will not affect standard service delivery.

16.5 Authorized Internal Staff Access: Access is limited strictly to operational needs per role. Staff are prohibited from personal use of client data or post-employment disclosure.

16.6 Pura Vida Pets Information: Clients agree to keep proprietary business information and non-public procedures confidential.

16.7 Rights of Data Subjects: Clients may exercise ARCO privacy rights under Costa Rican Law No. 8968 in accordance with our Privacy Policy.

17. Modifications to Terms and Conditions

17.1 Pura Vida Pets may update these Terms and Conditions as needed for operational, commercial, technical, security, or legal requirements.

17.2 Amendments will be communicated via customary official customer channels.

17.3 Updated terms govern new bookings, contracts, and renewals executed after the effective date.

17.4 Modifications will not retroactively alter essential terms of confirmed, paid services except where required by law.

18. Acceptance of Terms and Conditions and Privacy Policy

18.1 Website Acceptance: No handwritten signature required. Online bookings require completion of mandatory acceptance mechanisms prior to submission. Checkboxes are displayed unselected by default.

18.2 Independent Mandatory Checkboxes: Before submitting online requests, the client completes two mandatory confirmations: 1. «I have read and accept the Terms and Conditions of Pura Vida Pets.» 2. «I have read the Privacy Policy of Pura Vida Pets and consent to the processing of my personal data necessary to manage and provide the service.»

18.3 Optional Consents: Separate voluntary checkboxes are provided for: 1. Commercial communications and promotions. 2. Authorization to use pet photos/videos for promotional social media and website purposes.

18.4 - 18.6 Execution and Refusal: The client acknowledges having prior access to both documents. Bookings via WhatsApp or external channels (18.5) employ equivalent verification mechanisms. Refusing optional consents never justifies denial of ordinary services (18.6).

Pura Vida Pets maintains auditable electronic records: client identity, timestamp, accepted terms version, accepted privacy version, mandatory consents granted, optional consents selected or declined, and transaction reference. Retained for contractual oversight and legal compliance.

18.8 Current Versions: Acceptance applies to the active version presented at booking. Version archives are preserved for verification.

19. Governing Law and Jurisdiction

These Terms and Conditions are governed by and construed under the laws of the Republic of Costa Rica (including Consumer Protection Law No. 7472 and Data Protection Law No. 8968). Any controversy will be submitted to the competent administrative agencies (Comisión Nacional del Consumidor - MEIC) or competent courts of Costa Rica.

Privacy Policy and Personal Data Protection

1. Data Controller

The data controller responsible for the processing of personal data is Pura Vida Pets, operating in the Republic of Costa Rica and handling information in compliance with applicable Costa Rican data protection laws (Law No. 8968 and its regulations).

2. Scope of this Policy

This Privacy Policy applies to personal data collected through any of the following media, channels, or interactions:

3. Data We May Collect

Depending on the service utilized, Pura Vida Pets collects only information that is strictly necessary, relevant, and non-excessive for the corresponding purpose.

3.1 Identification and contact details: May include full name, phone number, email address, identity document number where required for invoicing or verification, and physical address or location needed to deliver the service.

3.2 Information related to the pet: May include name, species, breed, age, sex, physical characteristics, diet, routines, temperament, history of aggression or reactivity, medications, special needs, veterinary records needed for service delivery, and photos and videos taken during sessions. Whenever this information is linked to an identified or identifiable person, it is managed with corresponding confidentiality safeguards.

3.3 Emergency information: Emergency contact name, phone number, habitual veterinary clinic details, and specific instructions for medical emergencies. The client must ensure they hold proper third-party authorization before sharing emergency contact data.

3.4 Payment information: Amount paid, date, transaction reference, payment method, vouchers, screenshots of payments made via SINPE Móvil, payment status of bookings or services, and details needed to process refunds. The client must avoid sending passwords, security codes, banking credentials, or unnecessary financial information.

3.5 Service history and administration: Purchased services, active monthly packages, schedules, assigned walkers/sitters, completed services, cancellations, rescheduling, refunds, incident logs, Loyalty Card levels, rewards, package freezes, and commercial perks.

3.6 Communications: Communications maintained through official channels when necessary to answer inquiries, monitor service progress, record instructions, handle claims, verify agreements, and maintain contractual evidence.

3.7 Technical information collected via the website: When the website is enabled, certain technical data necessary for its operation and security may be collected, including: IP address, device type, browser, access date and time, technical logs, strictly necessary cookies, and session or platform operational data. Use of additional analytics, advertising, or tracking tools will be subject to implemented technologies and applicable notice and consent mechanisms.

4. Purposes of Processing

Pura Vida Pets may use personal data for the following legitimate purposes:

Data will not be processed for purposes incompatible with those for which it was originally collected without providing prior information or obtaining proper consent where required.

5. Consent

5.1 Prior informed consent: Where required, Pura Vida Pets will seek appropriate consent before collecting or using personal data. By voluntarily providing data through our forms, website, or official channels, the client confirms that information provided is accurate and that they understand the purposes for which it is needed.

5.2 Independent consents: Where a purpose requires separate consent — such as specific promotional communications or advertising photo use — Pura Vida Pets will request it separately through unbundled, affirmative opt-in mechanisms.

5.3 No commercial subordination: Acceptance of the Terms and Conditions does not automatically imply that the client must accept marketing communications that are not strictly necessary to provide the service.

6. Internal Access by Authorized Staff

6.1 Need-to-know principle: To properly provide its services, Pura Vida Pets may permit authorized team members, walkers, sitters, supervisors, and administrators to access client and pet data. Internal access is granted strictly when reasonably necessary to perform platform-related duties.

6.2 Differentiated access levels: Not all staff members necessarily have access to all available data. Pura Vida Pets applies role-based access control according to each user’s duties, ensuring staff only view information necessary for their specific tasks.

6.3 Assigned walker access: An assigned walker may require access to: client name or identification details, necessary contact numbers, delivery or pick-up address, service schedule, assigned pet profile, routines and instructions, temperament and safety precautions, medications or relevant care needs, emergency contacts, and other strictly necessary service instructions.

6.4 Administrative and supervisory access: Administrative or supervisory staff may require additional access to coordinate bookings, payments, incidents, customer care, staff scheduling, security, contractual compliance, and other legitimate platform operations.

All authorized personnel must use information exclusively for legitimate functions and remain bound by strict non-disclosure obligations. Pura Vida Pets enforces internal rules prohibiting: (a) using data for personal purposes; (b) unjustified browsing of client or pet profiles; (c) disclosure to unauthorized third parties; (d) extracting or keeping data outside platform systems; (e) using client data to solicit off-platform private services; (f) sharing passwords or access credentials; and (g) logging in via accounts belonging to other persons. Confidentiality obligations remain fully binding even after employment, contractual, or collaborative relationships conclude.

6.5 Access revocation and audit logging: When a collaborator ends their relationship with Pura Vida Pets or no longer requires permissions, their access is immediately revoked or adjusted. Pura Vida Pets may retain technical access and activity logs for security, audit, misuse prevention, and dispute resolution.

7. Sharing Information with Third Parties

Pura Vida Pets may share limited information when strictly necessary with:

In each case, Pura Vida Pets endeavors to share only data reasonably necessary for the corresponding purpose.

Pura Vida Pets will never commercialize, license, or sell personal customer databases as an independent product under any circumstance.

8. Future Online Payments

8.1 Specialized payment providers: If Pura Vida Pets incorporates card processing, payment gateways, or other electronic checkout tools, specific financial details will be processed directly by certified providers adhering to international security standards.

8.2 Policy updates: This Privacy Policy will be updated whenever necessary to identify the relevant features and vendors of the implemented payment infrastructure.

8.3 Minimal storage: Pura Vida Pets will restrict financial information stored directly by the business to what is strictly necessary to identify, confirm, audit, or refund a transaction.

9. Photographs and Videos

Pura Vida Pets may take photographs or videos of pets to: (a) report service delivery to the client; (b) monitor pet wellbeing; and (c) maintain reasonable records of the service performed.

9.1 Promotional and advertising purposes: The use of photographs or videos for promotional, marketing, social media, or website purposes is handled in accordance with terms communicated to the client and requires express authorization.

9.2 Right to opt out without penalty: The client may communicate at any time that they do not wish their pet’s content to be used for marketing purposes, without affecting regular service provision.

10. Marketing Communications

Pura Vida Pets may send notifications necessary to manage: bookings, services, payments, renewals, operational schedule changes, safety alerts, Loyalty Card status, and earned perks.
